He wasn't saying this specific event had a sexual assault. He's saying the prosecution of the Marine is going to stop others from intervening in the future. There have been links in this thread to youtube videos of assaults and even rape on public transit with no intervention from bystanders. The reaction to this event is only going to increase that risk. 1

It’s a shitty feeling knowing that a home invader has more rights in your home than you do. My philosophy, If the guy doesn’t leave when he hears a shotgun rack, it’s the universe telling me that I’m spending the rest of life behind bars. I go through episodes where I want someone to break in, just so I can use some of my slugs. My wife lets me know that I can’t do this in CA or I’ll go to jail. The criminals know this too. M2 Posted May 13, 2023 Posted May 13, 2023 I don't think his intent was to kill the homeless guy, but it is well known (even to the USMC) that prolonged use of a chokehold greatly increases the risk of death and there was no reason to continue to do so for several minutes after he became unresponsive (having lapsed into unconsciousness). A second-degree manslaughter conviction in New York requires a jury to find a person engaged in reckless conduct that created an unjustifiable risk of death, consciously disregarded that risk and acted in a way that grossly deviated from how a reasonable person would act in a similar situation. I think there's a valid case against Penny. How a jury sees it is yet to be seen.... 1

Prior to this, apparently he lived on the upper left and got away with it multiple times, including 3 unprovoked attacks on women. This should be sign to all the fucks on pubic transit who think they can just yell at everyone, threaten them and generally be assholes, that people will no longer put up with their shit. On another note, this is one of the reasons I'm happy I live where I do. No bums trying to walk away with my luggage (PDX), no bums pushing me as I walk by them (NYC), no bums screaming at me for not giving him money (ORD), no bums pissing in the streets (PDX), no bums blowing pot smoke at people as they walk by (MSP), no bums following you and yelling because you offered to buy them a sandwich after they ask me for money "for food" (SFO). These incidents have dropped dramatically since I started laying over mostly in Midwestern small cities. Here's hoping this Marine walks free...this world is a slightly safer space now. 2 1
