Yep, the Ninth Circuit Court of Appeals ruled that actually wearing medals or decorations not earned is NOT protected by the First Amendment, as it is conduct and not speech...

So to recap, a person can lie about it and be protected as long as they aren't doing so for financial gain (fraud), but they can't wear them.

Except that the law was re-written and no longer makes wearing them a crime. Since this guy was convicted under the old law, they ruled based on that law.
